The portion of right-of-way in question is the central artery through Tiburon's downtown. The Town is considering acquiring this portion of Tiburon Boulevard to improve local control over the heart of our community. The Town asked you to sponsor this bill in order to allow Caltrans to conduct the lengthy process of analyzing the impacts and conditions of any relinquishment. Only through this process can the Town determine whether it would be feasible to accept the roadway. We understand that AB 747 cannot be finally adopted until Caltrans has finished its studies. But your good work in moving this bill forward will allow our Town Council to make a fully informed decision about the roadway. We very much appreciate your efforts. Sincerely, Margaret A.. Curran Town Manager cc: Mayor and Town Council Ann Danforth, Town Attorney Nicholas Nguyen, Director of Public Works DIGEST TOWN OF TIBURON 07 1505 Tiburon Boulevard Tiburon, CA 94920 MEMORANDUM Date: April 16, 2013 To: Peggy Curran, Town Manager From: Nicholas Nguyen, Director of Public Works/Town Engineer Subject: All-Way Stop Sign Installation By Marin County at Trestle Glen Blvd & Paradise Dr. Marin County staff received a request from a resident to review the Trestle Glen Blvd/Paradise Dr intersection for placement of all-way stop control. The intersection is within the County's right-of-way (ROW). Currently, the south-bound approach on Paradise is required to stop, the north-bound approach is uncontrolled and the Trestle Glen Blvd approach (Town ROW) is required to yield. According to County staff, concerns were expressed about visibility at the intersection especially for left turning vehicles and speeds on Paradise Dr. Their staff reviewed the intersection for an all-way stop installation. Their findings and recommendation are as follow. The traffic volumes do not meet the minimum traffic volume multi-stop warrants in the Manual of Uniform Traffic Control Devices (CA-MUTCD) which require 300 vehicles for eight hourly periods on the main road and 200 vehicles for eight hourly periods on the minor road. Per the CA-MUTCD guidelines, five or more crashes in a 12-month period that are susceptible to correction by a multi-way stop is the recommended collision threshold. From collision data, the intersection does not meet this collision warrant. The existing minimum stopping sight distance is 160 feet. According to the American Association of State Highway and Transportation Officials (AASHTO) publication, "A Policy on Geometric Design of Streets and Highways", the minimum design stopping distance is 155 feet. Therefore, the minimum design stopping distance is satisfied on Paradise Drive. The CA-MUTCD includes additional criteria whereby multi-way stop control may be provided at an intersection of two collector streets where such controls would improve traffic operational characteristics. County staff feels that due to the radii of the turning movements and the presence of the raised pork chop island at the location, an increased potential exists for vehicles to overshoot the turn and hit the raised island and/or leave the traveled way. Along with another operational characteristic, County staff believes the intersection would benefit from all-way stop and consistency in traffic controls at all approaches. As you are well aware, even though the ridership is limited, there are still many people who need bus service. Getting back our old shelters, minus the commercial advertisements, is a big win for our community. We also appreciate being given the valuable opportunity to utilize the shelter ad space for Town messages. There are many times when we have public service announcements or informational notices of local non-profit events in Town, and this will be an excellent vehicle for spreading the word. Your efforts have beautifully smoothed over a small, but persistently prickly and locally important situation to everyone's benefit. We are most grateful! Curran Town Manager Sit T 36 Southridge West Tiburon, CA 94920 Telephone: (415) 381-4467 April 15, 2013 Design Review Board Town of Tiburon, California Dear Members of the Design Review Board, RECEIVED APR 15 2013 TOWN MANAUERs vt FiCL TOWN of T180RON Re: Application of George F. & Maureen Sandison - 4 Southridge East (Reedlands) Having lived in Tiburon for decades, and looking forward to spending our golden years in this beautiful community, we would like to preserve our bucolic environment, safe neighborhood, and long-term real estate values. The proposed project, less than 300 feet from our home, and downhill (south-west) from us, causes us concern: A) Design: The existing structure is a single-story house built unobtrusively into the hillside and below a garage that is at street-level. There has never been any living space at the street level--- only the garage--- and the house has thus, for decades, been barely visible from our home. Mr. Sandison wishes to replace this single-story, recessed house with a large two-story house having significant living spaces (entry foyer, bedroom, bathroom, multiple closets, elevator and staircase) plus garages at the street-level and with a dramatically reduced front setback. We met with Mr. Sandison at the site on February 16. We understood that his new structure would be in compliance with Tiburon's Design Guidelines for Hillside Dwellings, and we welcomed him to our community. We were pleased that an old house would be replaced by something new and, hopefully, enhance our neighborhood. However, when story poles were erected, it became clear that the new structure would not be integrated with the sloping site; thus, it would be at odds with Tiburon's long-standing Hillside Guidelines. A markedly reduced front setback would exacerbate the problem. Also, the new boxy 2-story structure, much of it above street-level, would erode our historical views of the estuary and Strawberry. Incidentally, the story poles have been placed behind tall fences and overgrown shrubs and trees. Because these poles are thus camouflaged, it is difficult to get a candid assessment of the proposed structure. We request, therefore, that Mr. Sandison's Application be continued for a reasonable time after pertinent portions of the camouflaging fencing and overgrowth are removed. Mr. Sandison has told us that he intends to remove these items; so, why not do it now? The house has been vacant since he purchased it approximately six months ago... Irrespective of the impact on our views, we request that consideration be given to terracing and use of vacant sub-structure spaces in the downhill slope so that the new house can be in conformity with the Hillside Guidelines, so that the need for such a pronounced setback- reduction is eliminated, and so that the new house is in harmony with the existing structure. y Design Review Board Page Two April 15, 2013 B) Construction Noise & Job Site Management: About one year ago, George F. Sandison moved from Texas to his quiet and secluded estate in Mill Valley, 156 Oakdale Avenue. Since then, he has purchased additional properties. He currently has at least three residential development projects in progress in southern Marin (84 Glenwood Ave in Ross, 16 Escalon Drive in Mill Valley and 4 Southridge East in Tiburon), all ostensibly to be his new "dream home", all with the same architect, and all having similar external characteristics. We respect, Mr. Sandison's prerogative to be a developer, and we wish him well. However, we would appreciate thoughtful consideration of our right to the peaceful, safe, healthful and quiet enjoyment of our home and neighborhood, especially given our age and our respective serious health issues and disabilities, and especially given the fact that this demolition and construction "project will take 2 to 3 years. We have conveyed these concerns to Mr. Sandison and requested reasonable accommodations". We were relieved when he initially seemed sensitive and understanding. Thereafter, however, Mr. Sandison informed us that his building contractors were not amenable, and we are worried about the health-impact of the prolonged disruption of our repose and tranquility. In light of lessons learned from the development projects of other non-resident owners, including being forced to leave our home and incur the vast expenditures of staying in hotels due to prolonged unbearable early-morning construction noise, we request that ultimate approval of Mr. Sandison's project be conditioned on clear Job Site Management rules with meaningful prophylactic sanctions similar to those of our sister-community, Belvedere. We urge a thoughtful balance between people's development desires and the health needs of residents. Given our demographics (almost-entirely a mature neighborhood of retirees), perhaps it is time for construction activity to start at 9 a.m. instead of 7 a.m. with the developer, in fairness, being allowed a couple of extra weeks to complete the job without penalty. Below, you will find a copy of an e-mail that was sent to the roughly 2,000 families involved in Scouting in Marin that outlines our guiding principles related to this issue. While the drafting of this statement was the result of recent surveys we conducted with our families, I would like you to know that these are the principles that your Marin Council Boy Scouts have followed for years - viewing individuals as Scouts or Scouters based on their conduct and character, not on group prejudice or stereotypes. Within the next few days, a National BSA resolution will be put forward that each of the 290 councils in the country will vote on in May. The National Executive Board is currently drafting that resolution and attempting to create a revision in policy that will accommodate viewpoints on the issue across many regional, religious, cultural, and generational lines. It is a societal change our organization is going through nationally that mirrors other societal issues surrounding sexual orientation that the country is addressing. The Marin Council's views, representative of our Marin County families, are as you can well imagine different than views on this matter in other states in our country. I wanted to reach out to you in advance of the breaking national story, because I do not know the nature of the resolution that will be presented. I wanted to share the guiding principles of our families and the leadership of the Marin Council, BSA because I hope you will find they are in keeping with the values of our general community. Whether is through the 2,000 families we serve annually, or the tens of thousands of Scouting alumni in Marin, our council has always valued our role in Marin County and our service to the community in providing quality programs for youth and adults through Scouting. If at any time as a result of this issue, you or a member of your staff needs to reach out to me to address a concern, please feel welcome to do so. I do not want the good works of our 2,000 Scouts or our nearly 1,000 volunteers overshadowed by contentious debates in other councils that have little bearing on how we as the Marin Council operate our programs for the youth and families we serve. Our council has received an outpouring of feedback from our Scouting families on this topic. All of these comments have been reviewed and discussed at length by our Executive Committee and then shared.with the National BSA to help-draft a resolution to be presented to BSA voting members in May. The dialogue our council leaders, parents, and supporters have undertaken has reaffirmed the important role that Scouting in Morin has had and can continue to have in shaping the lives and values of young,people. However, the current BSA membership policy clearly excludes an entire group based on a presumption of behavior rather than. on the actions of individuals. We cannot help but find that excluding an entire group of people based on stereotypes and prejudices is inconsistent with the Scout Oath and Scout Law. The current membership policy is of deep concern to many in Morin Council and inconsistent with the personal beliefs of a majority of our membership. As such, our Executive Committee has crafted a set of principles that we believe reflects the feelings and wishes of our membership regarding the national membership policy: As a council, we are guided by the principles. that: Scouts and Scouters should be judged by their conduct, their actions, and their character, consistent with the Scout Oath and Scout Law, not by stereotypes or group-related prejudices, The Scout Oath and the Scout Law are foundational ideas that every person should be exposed to so that all people can benefit from the Scouting movement's principles, ideals, and values, and, Regardless of sexual orientation, sexual topics and conduct, which include pointing out another individual's sexual orientation, are not part of the Scouting 2 movement and should not be tolerated. Further, the Scouting movement should not permit its organization to be used as a vehicle to promote any personal, political, social, or other objective that is inconsistent with the Scout Oath and Scout Law. In keeping with the Scout Oath and Scout Law and our guiding principles, we believe the National Board of the Boy Scouts of America should adopt a standard policy which ends the isolation and exclusion of individuals from Scouting solely on the basis of sexual orientation: Marin Council will learn the contents of any National Council resolution later this month. When we receive a resolution to consider, our Executive Board will have an opportunity to discuss any proposed resolution and determine, based on our principles and the weighed alternatives, what instructions our board wishes to give our council voting members. While we anticipate that each council will need to approach this matter through some spirit of compromise, until the specific resolution is produced from the BSA National Executive Board, how much compromise is required will just be speculation.
