untimely demise of our friend and Councilman, Dick Collins.
The Town welcomes your interest and appreciates the time you took to think about Ma
the opening and apply for the position. At the time you applied, neither you nor the
Town realized that you lived outside of the town limits; unfortunately, when our
"tentative" agenda was sent to The Ark, they picked up the fact that you were a
candidate tentatively scheduled for an interview for June 5. Don't worry; we have let

PROGRESS REPORT FOR BLACKIE'S GARDEN MAY 2013
In May we had 14 volunteer sessions.
That included watering by hose when very hot or very windy
to supplement our drip system.
Planting
Pruning
Weeding
Dead Heading
Installing new plant markers
Cleaned up to prepare for our garden tour of May 16
Had the tour May 13 with a very nice turn out.
One large shrub ' Cordyline electric pink) was half dead
due to dogs peeing on the plant. We transplanted it in
a less vulnerable location and spayed white hot pepper
as a repellent & put in many 1/4 inch X 2 foot bamboo stakes
around the plant so dogs can't get close to it. the other 4 Cordyline
are doing fine.
We added drip irrigation to the new plants
The last group of plants we installed were on June 31St
We do not plan to put in any more plants until the last half of Sept.
as it is too hot & the roots do not develop during those summer months
(the ideal time to plant is early November just as the winter rains start
But we often can't get the plants we want in November so times other than

AVAILABILITY OF INFORMATION
Copies of Design Review Board Agendas, Staff Reports, project files and other supporting data are available for
viewing and inspection at Town Hall during business hours. Agendas and Staff Reports are also available at the
Belvedere - Tiburon Public Library and on the Town of Tiburon website ( «,,A,.ci.tiburon.ca.us) after 5:00 PM on the
Friday prior to the regularly scheduled meeting.
Any documents produced by the Town and distributed to a majority of the Design Review Board regarding any item
on this agenda, including agenda- related documents produced by the Town after distribution of the agenda packet at
least 72 hours in advance of the Board meeting, will be available for public inspection at Town Hall, 1505 Tiburon
Boulevard, Tiburon, CA 94920.
Upon request, the Town will provide written agenda materials in appropriate alternative formats, or disability- related
modification or accommodation, including auxiliary aids or services, to enable individuals with disabilities to

PUBLIC HEARING ITEMS AND BUSINESS ITEMS
Public Hearing items and Business items provide the general public and interested parties an opportunity to speak
regarding items that typically involve an action or decision made by the Board. If you challenge any decision in
court, you may be limited to raising only those issues you or someone else raised at the meeting, or in written
correspondence delivered to the Board at, or prior to, the meeting.
GENERAL PROCEDURE ON ITEMS AND TIME LIMIT GUIDELINES FOR SPEAKERS
The Design Review Board's general procedure on items and time limit guidelines for speakers are:

❖ Applicant Presentation — 5 to 20 minutes
❖ Design Review Board questions of staff and /or applicant
❖ Public Testimony (depending on the number of speakers) — 3 to 5 minutes for each speaker; members of
the audience may not allocate their testimony time to other speakers
❖ Applicant may respond to public comments — 3 minutes
❖ Design Review Board closes the public testimony period, deliberates and votes (as warranted)
Time limits and procedures may be modified in the reasonable discretion of the Chairman
Interested members of the public may address the Design Review Board on any item on the agenda.
ORDER AND TIMING OF ITEMS
No set times are assigned to items appearing on the Design Review Board agenda. While the Design Review Board
attempts to hear all items in order as stated on the agenda, it reserves the right to take items out of order without
notice.

TOWN OF TIBURON LATE MAIL POLICY
(Adopted and Effective 11/7/2007)
The following policy shall be used by the Town Council and its standing boards and commissions, and by staff of
the Town of Tiburon, in the identification, distribution and consideration of late mail.
DEFINITION
"Late Mail" is defined as correspondence or other materials that are received by the Town after completion of the
written staff report on an agenda item, in such a manner as to preclude such correspondence or other materials
from being addressed in or attached to the staff report as an exhibit.
IDENTIFICATION OF LATE MAIL
All late mail received by Town Staff in advance of a meeting shall be marked "Late Mail" and shall be date -
stamped or marked with the date of receipt by the Town. Late mail received at a meeting shall be marked as
"Received at Meeting" with a date -stamp or handwritten note.
POLICY
For regular meetings of the Town Council and its standing boards and commissions:
(1) All late mail that is received on an agenda item prior to distribution of the agenda packet to the reviewing
authority shall be stamped or marked as "Late Mail" and shall be distributed to the reviewing authority
with the agenda packet.
(2) All late snail received on an agenda item before 5:00 PM on the Monday prior to the meeting shall be
date - stamped and marked as "Late Mail" and distributed to the reviewing authority as soon as practicable.
Such mail shall be read and considered by the reviewing authority whenever possible. If the Monday, or
Monday and Tuesday, prior to the meeting are a Town - recognized holiday, the deadline shall be extended
to the following day at Noon.
(3) Any late snail received on an agenda item after the deadline established in paragraph (2) above shall be
date - stamped, marked as "Late Mail" and distributed to the reviewing authority as soon as reasonably
possible, but may not be read or considered by the reviewing authority. There should be no expectation
of, nor shall the reviewing authority have any obligation to, read or consider any such late mail, and
therefore such late mail may not become part of the administrative record for the item before the
reviewing authority.
These provisions shall also apply to special and adjourned meetings when sufficient lead time exists to implement
these provisions. If sufficient lead time does not exist, the Town Manager shall exercise discretion in establishing
a reasonable cut -off time for late mail. For controversial items or at any meeting where a high volume of
correspondence is anticipated, Town staff shall have the option to require an earlier late mail deadline, provided
that the written public notice for any such item clearly communicates the specifics of the early late mail deadline,
and the deadline corresponds appropriately to any earlier availability of the agenda packet.
Pursuant to state law, copies of all late mail shall be available in a timely fashion for public inspection at
Tiburon Town Hall, 1505 Tiburon Boulevard.

NOTICE OF PUBLIC HEARING
AMENDMENTS TO MARIN COUNTY CODE TITLE 22 (DEVELOPMENT CODE)
STREAM CONSERVATION AREA ORDINANCE
NOTICE IS HEREBY GIVEN that the Marin County Board of Supervisors will hold a public
hearing to consider proposed amendments to Marin County Code Title 22 (Development
Code) that would modify Title 22 (Development Code) by: (1) establishing Chapter 22.33
(Stream Protection) and Chapter 22.63 (Stream Conservation Aregi Permits); (2) providing new
definitions and amending the text of definitions in Chapter 22.130 (Definitions); (3) amending
the text of Sections 22.06.050 (Exemptions from Land Use Permit Requirements), 22.08.040
(Agricultural District Development Standards), 22.40 (Application Filing and Processing, Fees),
22.42.025 (Exemptions from Design Review), 22.42.045 (Design Review for Development
Along Anadramous Fish Streams and Tributaries), 22.42.055 (Project Review Procedures),
22.56.050 (Decision and Findings for New Second Units) and 22.62.040 (Exemptions) as
necessary to effectuate the expansion of regulations for the Stream Conservation Area (SCA).
The proposed amendments are applicable to those perennial, intermittent and ephemeral
streams identified in the Stream Conservation Area map and data that is maintained and
periodically updated by the Marin County Community Development Agency.
The proposed amendments to the Development Code are within the scope of the certified
2007 Countywide Plan Environmental Impact Report (EIR). A subsequent or supplemental EIR
is not required pursuant to State CEQA Guidelines Sections 15162 and 15163 because the
project does not involve or result in substantial changes to the 2007 Countywide Plan involving
new or substantially more severe significant environmental effects, nor does the proposal
involve new information that was not known at the time the EIR for the Countywide Plan was
certified. Further, the project is exempt from CEQA pursuant to Sections 15307 and 15308 of
the CEQA Guidelines (Classes 7 and 8. Protection of Natural Resources and Protection of the
Environment) because the project sets the regulatory framework for permitting in accordance
with the CWP and increases protections afforded to streams and riparian habitat as compared
with current County regulations.
NOTICE IS HEREBY FURTHER GIVEN that said public hearing will be held at the regular
meeting of the Mann County Board of Supervisors on Tuesday, June 18, 2013, in the Board of
Supervisors Chambers (Room #330 - Administration Building), Civic Center, San Rafael,
California, at the hour of 1:30 p.m. Any interested party may appear and be heard at this time.
Please call the Community Development Agency - Planning Division, at (415) 473 -6269 on the
Friday before the scheduled meeting to obtain a copy of the staff report, or visit our website at

The proposed ordinance and additional information about the Stream Conservation Area may

Written material for the Board of Supervisors should be submitted to the Community

What does this mean to you? }
Starting this summer; the ordinance will hit every parcel in Marin within a "stream con servation area" XA)
For many properties the SCA extends 150 feet on both sides of any creek or stream. It would include "ephemeral
streams," which are surface runoffs of water during rains.
The stream ordinance will:
• Impose restrictions on all existing homes and improvements,
• Stop new house construction on undeveloped lots,
• Require high permit fees and expert reports for minor home improvements,
• Depress sales of homes located near streams- what will be the value of your home?
MARK YOUR CALENDARS WITH THESE DATES:
• Thursday June 13 at 7 pm. All are welcome at 660 Las Gallinas Avenue in San Rafael (across the street from Macy )s
in the Northgate Mall.) We will give you a summary of the proposed ordinance, help locate your property on the
County stream map, and answer questions about how the ordinance effects your home.
• June 18, 9:00 am at Civic Center Room 328 in San Rafael. Each person will be allowed 3 minutes of public comment.

Tell the County of Marin Supervisors to Make the Stream Ordinance Clear, Affordable, Simple and Effective by
adopting the following:
• Reduce the stream setback to 35 feet, as recommended by scientists. Current draft imposes 150 foot setback in West
Marin, Nicasio and Novato, and setbacks of 20 to 100 feet in eastern and southern Marin, depending on lot size
and location.
• Limit protections for «ephemeral streams)) (surface runoff) to 20 foot setback. Apply only to ephemerals which are
accurately mapped, drain directly into fish - bearing creeks, and have 100 feet of riparian vegetation.
• Exempt from stream permits all existing homes, structures, improvements and disturbed areas. Apply this «grandfa-
ther» exemption to all existing homes, whether now permitted or partially unpermitted. Do not use stream protec-
tions as a tool for County Code enforcement.
• For grandfathered existing structures, create broad exemptions for improvements, remodels, replacements, and addi-
tions (up to 500 square feet increased footprint), with no stream permits required.
• Reduce permit fees and eliminate expert reports. Allow the homeowner to hire his own professional for site assess-
ments, if required.
• Limit the stream setbacks to areas accurately mapped when the ordinance takes effect. Give fair notice so owners
can correct mapping errors. Do not allow County or private environmental groups to add or change stream loca-
tions on future maps

Who Are The San Geronimo Valley Stewards?
San Geronimo Valley Stewards is a non profit that has over 300 active supporters and donors that reside in
Woodacre, San Geronimo, Forest Knolls and Lagunitas along with property owners around the County. We have
no employees or paid staff. We hold public meetings to inform neighbors and our members about current issues
affecting riparian plants, wildlife, and property owners.
We are pleased to have worked and maintained professional relationships with Trout Unlimited, Cal Trout,
Marin Municipal Water District, Regional Water Quality Control District, and Lagunitas Technical Advisory
Committee. However, this cooperative access is threatened by aggressive County enforcement actions, and by
numerous and costly lawsuits filed from SPAWN (a salmon advocacy group) against the County.
Voluntary Stewardship Will Save Our Creeks and Wildlife
The most important people for stream habitat and salmon are the families who live along the creeks around
Marin County. We need all of you in our community, not just an ordinance, to preserve the health of our streams
and the salmon.
