HomeMy WebLinkAboutTC Min 1994-01-10 ~ TOWN COUNCIL MINUTES CALL TO ORDER Mayor Friedman called the adjourned meeting of the Town Council of the Town of Tiburon to order at 8:05 P.M., Monday, January 10,1994 in the Music Room of Del Mar School, Tiburon, California. A. ROLL CALL PRESENT: COUNCILMEMBERS: Thayer, Kuhn, Nygren, Thompson, Friedman ABSENT: COUNCILMEMBERS: None EX OFFICIO: Town Manager Kleinert, Town Attorney Ewing, Town Engineer Bala, Finance Director Stranzl, Town Clerk Hennessy B. APPOINTMENTS TO COMMISSIONS BOARDS. COMMITTEES There were no appointments. ~ C. PUBLIC OUESTIONS AND COMMENTS There were none. D. PUBLIC HEARING 1. PROCEEDINGS TO ESTABLISH NEW TOWN CENTER COMMUNITY FACILITIES DISTRICT AND TO INCUR BONDED INDEBTEDNESS AI Kuhn, Chairman of the New Town Center Committee, explained the legal necessity to send notices to every registered voter and every property owner within the boundary limits of the proposed Community Facilities District (CFD); gave background of the New Town Center Committee and citizen Site Selection and Finance Committees. a. Proposed Financing Plan CFD 1994-1 ,.. Mark Pressman, Mark Pressman Associates, eXplained the need to request more funds than needed due to delinquencies; changes in demographics of the community, and service fees of the District; explained there were criteria set by rating agencies in order to get a lower interest rate. Mr. Pressman used the overhead projector to illustrate a typical tax bill; explained excess funds would not be used unless there were unforeseen circumstances; explained description of taxable parcels; explained the longer the term the lower the per unit rate; proposal is for 40 year term; rating agencies have indicated they prefer 35 year terms; Committee anticipates a $65 per year tax levy; believed the TOWN COUNCIL MINUTES #996 1/10/94 1 r-- - proposal was the most efficient, fastest and least costly that the Tiburon electorate will be faced with; Town needed to be cautiously conservative; other methods of financing will be more costly. Mr. Pressman noted that he and Irving Scwhartz, Project Engineer, were donating their services to the Town. Chairman Kuhn reviewed the existing conditions of the current Town Hall and Police Department. . b. Project Report Stan Bala, Town Engineer, reviewed the Project Report which is required by the Government Code Section 53321.5. c. Report of The Committee for Tiburon New Town Center Mark Ginalski, Chairman of The Committee for Tiburon New Town Center stated they are preparing an informational brochure; will meet with the Homeowner Associations; conduct an Open House at Town Hall and Police Department. ~ Steve Kline, survey preparer, explained the telemarketing techniques used for the Town survey of approximately 300 persons; results show the electorate doesn't know as much about this issue as the people in this room and those working on it for the past 2 1/2 years; 60% of the public don't know the existing conditions of Town Hall; 48% of the public don't know whether $200/sq.ft. is reasonable; had the election been between December 13 and 15, you would not have succeeded; can't predict whether the issue will be successful on April 12 or June 7. Mark Ginalski stated his Committee recommends June 2 for the election in order to get more information to the public. Steve Kline stating competing with the RUSD and County Library system might have a deleterious affect on the Town's measure. Resident, Little Reed Heights, noted their area is considering an undergrounding of utilities district. There was a brief discussion regarding tax burden thresholds. Ed Ness, Bond Counsel, noted delinquencies would be recovered and the tax rate adjusted accordingly. In response to Councilmember Thayer, Mr. Pressman stated the assessment is not a General Obligation bond and everyone is assessed the same amount. d. Public Comments The Mayor opened public comments, and asked if there were any protests. " Don Batten, Mercury Avenue; Louise Teather, Town Historian, supported the New Town Center. TOWN COUNCIL MINUTES #996 1/10/94 2 r"' The Town Manager noted the Project Engineer, Irving Schwartz, calculated that the Town received 14 letters; one asked for an exemption for an unbuildable parcel; one was unclear and considered a protest; noted if all those persons signing the protest letters who live within the Town limits and are registered voters, then a total of fifteen registered voters filed protests which represents 0.27% of the total of 5,552regi~tered voters; the land area owned by the protesters comprises 6.8 acres or 0.52%bf the approximately 1,300 privately-owned acres of land area within the Town of Tiburon. ~ There being no further comments, the Mayor closed the public hearing. e. Town Council Comments and Decisions Chairman Kuhn reviewed the survey and the conclusion that the public lacked an understanding of the project, and recommended the bond measure be postponed to the June ballot. Council discussed the cost of a June election; delayed construction increasing costs; competing with other measures on the April ballot; the need to educate the public. Ed Ness pointed out that reference to excess funds being used for future maintenance will be eliminated; the proceeds can only be used to retire the debt. Lisa Montecelli, 21 Marinero Circle, stated very few people are informed of this project. ~ Russ Wisch ow, suggested the Council do a Certificate of Participation and let services go to hell for a few months and people will wake up. The Mayor thanked Mr. Wischow for the work he has done on the New Town Hall Committees; stated he would like to think he acts in a knowledgeable manner by not taking the action he suggests; while he recognized the need for a New Town Hall, he believed it was equally important not to cut back on services; not to layoff members of the Police Department; before he would participate in that decision he wanted the majority of the Town to tell him they wanted that action. E. OLD BUSINESS 5. TOWN SURVEY PRELIMINARY RESULTS (Questions and Discussion with Steve Kline Campaigns) This discussion had been incorporated in previous discussion. F.
