Dear Mr. Segal:
This letter responds to your June 5, 2013 request to Tiburon Town Manager Peggy
Curran for information concerning the Town of Tiburon's residential resale inspection
process. Your request asks three specific questions, which are responded to below:
1. How much is collected in resale inspection fees each year?
Response: In calendar year 2012, $41,525 was collected. In calendar year
2011, $39,950 was collected. In 2010, $26,350 was collected. The number of
resale inspections performed by the Town increased in each of these years.
2. How is the resale inspection program structured and administered?
Response: The Building Official and the Building Inspector are assigned to
the resale inspection program. Either the property owner or listing agent may
request a resale inspection prior to sale. The fees for resale inspection report
are $250 for the first dwelling unit and $75 for each additional unit.
Inspections are typically scheduled the same day as requested, and are
conducted within ten working days of the request and much sooner if possible.
A written report is generally issued at the conclusion of the inspection;
however, additional records review may occasionally be required, for example,
if potentially un- permitted work is found. In such cases, a report will be issued
within three working days. The report identifies items that are advisory in
nature as well as life- safety corrections that are mandatory in nature. Either
the current property owner or the new buyer may assume responsibility for
correcting mandatory items identified in the resale report.
3. How does the Town spend the fees that are collected for the program?
Response: All fee revenue accrues to the General Fund. As noted in
previous communications, the resale inspection revenue does not exceed the
cost of providing and performing the service.
Thank you for your interest in the residential resale program. The Town believes that
substantive improvements and streamlining measures have been made to its resale
process over the past year, and we will continue to work on improving this beneficial
safety program.

Thank you for the opportunity to submit comments on the EIR Response to Comments Cuairniber
document dated June 2013, prepared for the Easton Point Residential Development
project. Our comments areas follows:
2. In similar vein, the Response to Comments document (Master Response 7)
describes the contemplated MERA facilities adjacent to the proposed water tank as
"highly visible" and "contributing to the previously- identified significant visual
impacts ", which are in actuality significant unavoidable impacts as set forth at p. 727
of the DEIR. To the extent possible, the MERA facilities (equipment building,
generator /fuel tank, antenna support structure) should be partially buried or otherwise
screened to reduce visual impact. This should be added as a mitigation measure if
feasible.
3. The Water Service Impacts and Inadequate Fire Flow discussions at pp. 472 -476 of
the DEIR appear to leave unresolved the issue of whether certain higher elevation lots
could ultimately be built upon with residences. The Response to Comment No. 6 -18
acknowledges that it is reasonable to question to feasibility of the mitigation measures,
since they rely on unknown future calculations and substantial coordination between
multiple agencies, with no guarantee of future acceptance by those agencies. It seems
illogical for the County to approve lots on a Tentative Map application for which
a.
water pressure and fire flow regulations may not be achievable or acceptable to the
relevant agencies. Before deciding on the merits of keeping those lots, we urge the
County to seek more definitive resolution from the applicant, water district, and fire
district regarding the likelihood of acceptable implementation of the mitigation
measures and therefore the fate of the lots.
4. Mitigation Measure 5.1 -7(b) [MM 6.1 -7(b) in Alternative 2] calls for the Town of
Tiburon to prohibit parking along 820 linear feet of Diviso Street, and along 1,100
linear feet of Centro East Street, in order to address pedestrian safety issues on Old
Tiburon streets that would be exacerbated by the Easton Point project, which were
deemed a "significant" impact on DEIR p. 243. Response to Comment No. 6 -7 states
that implementation of this measure would result in a loss of on- street parking. Given
the general scarcity of parking in Old Tiburon, every parking space is valuable. Any
Town decision to eliminate parking spaces would need to be carefully studied and
considered, but the likelihood of the Town approving wholesale elimination of on-
street parking on these street segments appears unlikely, especially if the number of
such spaces being eliminated is numerous. One side - effect of this mitigation measure
could be to exacerbate an existing parking shortage in Old Tiburon. Would this
impact remain a significant and unavoidable safety impact, in the opinion of the EIR
preparers, if this mitigation measure is not implemented?
5. Response to Comment No. 1 -2 indicates that the EIR analysis does not support
widening of Paradise Drive along the property frontage to 12 foot wide travel lanes
with four foot wide shoulders on both sides, as recommended by the County Public
Works Department. The Town agrees with the EIR finding and believes that the
widening proposed by the County Public Works Department would dramatically alter
the existing visual character of 1.1 miles of Paradise Drive. Instead, we encourage
selective paved shoulder widening of numerous segments of the Paradise Drive
roadway frontage to provide improved bicycle and pedestrian passing/turnout areas.
A drawing showing suitable locations for such shoulder widening has been previously
provided to the County Public Works Department.
6. The proposed widening of the temporary construction road from 10 feet to up to 20
feet in width (Master Response #2) is unfortunate and will result in even larger scars
on the site, whether or not it is eventually removed.
7. The Response to Comment 6 -13 regarding street ownership appears .to respond to a
different comment regarding fire service impacts and is clearly misplaced.
8. The Response to Comment 6 -19 does not address the question raised in the final
sentence, regarding implications to fire safety of having substandard hydrant pressure
at the upper reaches of the site.

The Town of Tiburon adopted its Housing Element for the 2007 -2014 planning period
on February 1, 2012. HCD subsequently found the element to be in full compliance
with State housing element law (HCD letter dated April 18, 2012). The Town is now
preparing an update of the element and would like to verify eligibility for a M
streamlined update in advance of submittal of the revised element.
The enclosed Implementation Review form details the Town's implementation of the
required programs. We would appreciate it if you could confirm the Town's
eligibility for a streamlined update based on this completed form. Please let me know

NOTICE OF PUBLIC HEARING
Wednesday, August 14, 2013 at 7:30 P.M.
Town Council Chambers, 1505 Tiburon Boulevard
Notice is hereby given that the Tiburon Planning Commission will hold a
public hearing to consider an application filed by Decker - Bullock Realty for a
conditional use permit to establish a professional real estate sales office in the
Village Commercial zone. The use is proposed to be located at 1704 Tiburon
Boulevard (fronting Fountain Plaza) and would occupy an approximately
1,295 square foot vacant space formerly occupied by a dry cleaning
establishment. The project site is Marin County Assessor Parcel No. 059 -102-
17.
The public hearing will be held at the Town Council Chambers, 1505
Tiburon Boulevard, Tiburon, California, on Wednesday, August 14,
2013. The meeting will begin at 7:30 P.M.
Information on this item is available for review at the Tiburon Community
Development Department at Tiburon Town Hall, 1505 Tiburon Boulevard,

Hi all .. Well, I made a mistake and misinterpreted Mill Valley's position on the Plan Bay Area from an email I

CORRECTION: In my recent Marin Voice article regarding the Plan Bay Area, I mentioned that
Mill Valley had "indicated their support for the Plan Bay Area ". I have since been notified that
the Mill Valley City Council did not take a position on the Plan Bay Area which reinforces my
ultimate vote to abstain from supporting or opposing the preferred scenario of the Plan Bay
Area.
I am sorry for any misunderstanding.

NOTICE: PACIFIC GAS AND ELECTRIC COMPANY APPLIES TO RECOVER COSTS FOR HERCULES MUNICIPAL
UTILITY ACQUISITION (A.13 -07 -001)
On July 1, 2013, Pacific Gas and Electric Company (PG &E) submitted an application to the California Public Utilities
Commission (CPUC) to collect $6.4 million from PG &E customers over the period 2014 -16 to cover costs associated with
PG &E's recent purchase of the Hercules Municipal Utility (HMU) assets. HMU is a municipal electric utility that has been owned
and operated by the city of Hercules since March 2003. Once the purchase is complete, PG &E intends to provide electric
service to all customers formerly served by HMU.
How will PG &E's application affect me?
PG &E's electric revenue requirements will increase by $3.4 million in 2014; however, the purchase of HMU's assets is expected
to generate $1.6 million in benefits, reducing the net increase to $1.8 million in the first year of the acquisition. Even without the
expected benefits, this increase is less than one percent of PG &E's total revenues. Initially, system average bundled rates will
increase 0.025 percent. This is expected to have a negligible impact on bills; a residential customer who uses 550kWh a month
will see an increase of less than three cents a month (individual customer bills may vary).

How does the CPUC's decision making process work?
The application will be reviewed through the CPUC formal administrative law process. The application will be assigned to a
CPUC Administrative Law Judge (ALJ). The ALJ presides over the proceeding, which develops a formal record that the ALJ
relies upon in drafting a Decision to present to the five - member Commission. The CPUC's Division of Ratepayer Advocates
(DRA) will review this application and participate in the proceeding. The DRA is an independent arm of the CPUC, which
represents the interests of all utility customers. The DRA's views do not necessarily reflect those of the CPUC. Other parties of
record may also participate.
Evidentiary hearings are often held in a proceeding to give parties of record an opportunity to present evidence or cross -
examine witnesses. Members of the public may attend but not participate in these hearings.
After considering all proposals and evidence presented, the ALJ will issue a draft decision based upon the established record.
When the CPUC acts on this application, it may adopt all or part of PG &E's request, amend or modify it or deny the application.
