INTRODUCTION OF NEW TOWN EMPLOYEES Patrick Kerslake — Senior Maintenance Worker 0 Jerry Jones — Police Officer Director of Public Works /Town Engineer Nguyen introduced the newest member of the department, Patrick Kerslake. He said that Patrick had started work for the Town several months ago and had subsequently applied for and been offered the Senior Maintenance Worker position. The Director noted that Patrick had previous experience working with an engineering firm. He also noted that Patrick and his wife are local residents who had both grown up on the Tiburon Peninsula. Mayor O'Donnell and the Council welcomed Mr. Kerslake to the Tiburon "team". Chief of Police Cronin introduced newly - installed Police Officer Jerry Jones, a former Marin County Sheriff (for 26 years) and investigator, member of the U.S. Army National Guard prior to that time, and graduate of UCSB. Officer Jones said that he was looking forward to becoming part of the Tiburon family and getting to know everyone in the community. The Mayor and Council welcomed him to the Town. Town Investment Summary — Accept report for period ending July 31, 2013 (Director of Administrative Services Bigall) Downtown Restroom Renovation Project — Authorize award of contract for project (Director of Public Works /Town Engineer Nguyen) — to be submitted 4. Employee Commendation — Adopt resolution commending Director of Community Development Anderson for 25 years of service to the Town of Tiburon (Town Clerk Crane Iacopi) Mayor O'Donnell said that Item No. 4 would be removed from the agenda and continued. MOTION: To adopt Consent Calendar Item Nos. 1, 2 and 3, as written. Moved: Fredericks, seconded by Fraser Vote: AYES: Unanimous ABSENT: Doyle, Slavitz ACTION ITEMS 1. Consideration of actions related to the November 5, 2013 Election — Consider adoption of resolution making appointments in lieu of election, or direct staff to hold an election for the purpose of electing four Town Councilmembers (Town Clerk Crane Iacopi) Town Clerk Crane Iacopi said that as of the close of the filing period on August 9, 2013, the three incumbents were the only filers for the three, four -year seats. She also noted that although three residents had taken out nomination papers for the two -year Council seat (created by the demise of the late Councilmember Collins), only one candidate had filed and qualified — Planning Commissioner Erin Tollini. The Town Clerk said the Council filing period had opened on July 15, 2013 and had closed for non - incumbents on August 14, 2013. She said these facts had been publicly noticed and that the Ark had highlighted the Council vacancies and nomination process frequently during the filing period. At this time, Crane Iacopi said that because the same number of candidates had filed as there were seats, the Council had the following courses of action to consider, pursuant to the Elections Code: 1. Appoint to the office the person who has been nominated. 2. Appoint to the office any eligible voter if no one has been nominated. 3. Hold the election if either no one or only one person has been nominated. Town Council Minutes #12 -2013 August 21, 2013 Page 2 If the Council chooses to appoint in lieu of holding an election, Crane Iacopi said the persons appointed would take office and serve exactly as if elected at a municipal election for the office. In other words, the appointees would be sworn in and commence their terns at the first regular Council meeting in December (December 4, 2013). Finally, Town Clerk Crane Iacopi said that if the Council does not appoint the four nominees to fill the four seats by the 75th day before the municipal election (August 22, 2013), pursuant to (1) or (2) above, the seats shall be filled by an election. The Town Clerk said that if the Council chooses to hold an election, the Marin County Registrar of Voters' office estimated the cost at between $1.75 and $3.00 per voter. Since Tiburon has just over 5,900 registered voters, she said the cost would range between $10,000 and $17,000. She also noted that once an appointment has been made, the elections official shall not accept for filing any statement of write -in candidacy (Election Code Section 10229(c)). Town Clerk Crane Iacopi said that staff had prepared a draft resolution allowing for appointment for the Council's consideration. Mayor O'Donnell said that it might be useful to structure the upcoming Homeowner's Summit to include a direct question and answer interaction with the erstwhile "candidates" to allow residents to pose some of the same questions that they might have asked if there had been a candidate's forum. The Council concurred with this recommendation and Town Manager Curran said that she would return to the Council with some ideas on how to structure the evening at a subsequent Council meeting. Councilmember Fraser also commented how some other connnunities, such as Mill Valley, have a "meet the Council" event on a Saturday in a public location. He said this might be worth considering, as well. MOTION: To adopt the resolution cancelling the election and appointing four members to the Town Council: Jim Fraser, Alice Fredericks, Emmett O'Donnell for the three, 4 -year seats, and Erin Tollini to the 2 -year seat. Moved: Fredericks, seconded by Fraser Vote: AYES: Unanimous ABSENT: Doyle, Slavitz Vice Mayor Fredericks reported on a "gut and amend" bill in the State Legislature that would redefine and preclude some uses of private and public money. She said the League and others were writing letters to oppose this bill, as it would be hannful to cities. Town Council Minutes #12 -2013 August 21, 2013 Page 3 Mayor O'Donnell reported on the success of the Tiburon Art Festival and Art by the Bay. He asked that everyone who worked on these events, from the smallest donor and volunteer on up to the Drever family (sponsors of Art by the Bay), be personally thanked by the Town. Town Manager Curran said that she had extended an invitation to the Drever family to attend a Council meeting in September for this purpose. Mayor O'Domiell expressed an interest, as well, in seeing a continuation of the display of public art in conjunction with the Tiburon Art Festival. The Town Manager said there had been talk of another Art by the Bay, in future. Town Manager Curran said that a speed awareness sign had been installed on Centro East Street, a long- standing desire of the residents there. She said it was a mobile sign and could be relocated to other locations, as well, if needed. She said a second sign would be placed near Trestle Glen.
