Please note however, that the Town Council is not able to undertake extended discussion or action on items not on the agenda. Matters requiring action will be referred to the appropriate Commission,Board, Committee or staff for consideration or placed on a future Town Council meeting agenda. TOWN OF TIBURON Town Council Special Meeting 1505 Tiburon Boulevard December 7, 2017 F .. s r ter Tiburon,CA 94920 Agenda Item:Al — 1 STAFF REPORT To: Mayor and Members of the Town Council From: Office of the Town Manager Subject: Recommendation to Consider an Interim Appointment for Upcoming Town Co cil Vacancies Reviewed By: ` BACKGROUND In the event of a Town Councilmember resignation, under the California Government Code, the Council must make an appointment or call a special election within sixty (60) days of the effective vacancy date. Vice Mayor O'Donnell announced his resignation from the Town Council to be effective at the end of his final Town Council meeting, on December 6, 2017. Vice Mayor O'Donnell's resignation falls approximately one year before his term expires. The Council has several options to consider for this seat until the November 6, 2018 municipal election when a new councilmember will be elected to a full four-year term. ➢ Call a Special Election to be held on April 10, 2018 to elect a councilmember to serve until the date of the November 6, 2018 election. ➢ Appoint one interim councilmember to serve until the date of the November 6, 2018 general election. Steps Required for a Special Election The Town Council will need to call the special election by resolution before the end of the year for it to take place in April. The person elected in April will serve only until the November 6, 2018 election. The Council should also indicate if it desires to appoint an interim councilmember to serve until April. Due to the high cost of conducting a special election and the short period covered, staff does not recommend this option for filling Vice Mayor O'Donnell's seat. Steps Required for an Interim Appointment This step also requires prompt action. Per the Government Code, an appointment must be made within 60 days of the effective date of the resignation. In this case, the appointment must be made before February 5, 2018. To ensure a timely appointment, staff would like to begin the standard appointments process immediately. This entails advertising the vacancy according to regular procedure, accepting applications, and scheduling interviews with the Town Council. The timeline for appointing an interim councilmember with this deadline will greatly depend on how many applications are received and availability for interviews. Tentatively, Town staff proposes the following timeline to consider: Open Close Interviews Potential Appointment Dates Application Application December 7, January 5, January 10 (special meeting) January 17 (regular meeting) 2017 2018 January 17 (regular meeting) January 24/31 (special meetings) The Council likely recalls the interim appointment process, having just completed a large recruitment for two interim Town Council positions less than one year ago. The Town's Appointment Policy (Resolution No. 16-2007) gives the Mayor discretion to waive the interview of any applicant the Council has interviewed within the past year. Staff is also seeking direction from the Council if it desires to re-interview any of these applicants, assuming any of those individuals reapply. FINANCIAL IMPACT The special election will likely cost the Town between $7.50-$8.00 per registered voter. Appointing an interim Councilmember will create no extra cost for the Town. RECOMMENDATION Staff recommends that the Town Council direct Staff to publish a notice of unscheduled vacancy on the Town Council, begin accepting applications and schedule interviews for applicants.
