TOWN COUNCIL
MINUTES
CALL TO ORDER
Vice-Mayor Thompson called the regular meeting of the Town Council of the Town of
Tiburon to order at 7:35 P.M., Wednesday, June 1, 1994 in Room 5, Del Mar School,
Tiburon, California.

D. COUNCIL COMMISSION OR COMMITI'EE ORAL REPORTS
. MARIN COMMUNITY FOUNDATION MEETING-
Council accepted written report from Mayor Nygren. Vice-Mayor Thompson announced
the Parents Review Committee will receive a $4,000 grant from the Foundation for the
Older Children's Playground.
. MARIN COUNTY HAZARDOUS & SOLID WASTE JPA MEETING -
Council accepted written report from Mayor Nygren.

5. TALDAN DEVELOPMENT AGREEMENT (Assignment of Rights)
The Town Attorney reviewed the Staff report; stated Council had approved the extension
of time for the payment of fees and asked for more information regarding Mr. Kaplan
and Mr. Ham regarding assignment of the Development Agreement rights to them; they
provided financial and professional references and based on this information, Staff
recommends approving the assignment of rights pursuant to paragraph 9.1 of the
Development Agreement.

6. McKEGNEY GREEN USE POUCY (Approve Amended Rules & Regulations as
Recommended by Jt. Recreation Committee)

The Town Manager reviewed the revised Rules & Regulations for McKegney Green
which requires the use of cleats; Jt. Recreation Committee, based on input regarding
maintenance provided by the Town's Public Works Department, recommend that the
future cleat use be prohibited for adults and limited for young people; one of the major
problems is that there is not sufficient time for the Town to devote to maintenance due
to heavy usage.
Doris Dante, Pine Terrace, stated use of McKegney Green results in a parking problem
for Pine Terrace; requested Council include a stipulation that once a permit is issued,
parking should be at Blackie's Pasture and not in residential areas.

The Town Attorney suggested Jt. Recreation request people use Blackie's Pasture when
they issue the permit.

Martin Kuntz, 136 Avenida Miraflores, Boardmember of Tiburon Peninsula Soccer
League, and player/manager of Mayflower Soccer League, reviewed their permit
application process, which affected 20 teams in their League; schedules and games
proceeded; two weeks later their permit was revoked; felt process was unfair; stated
there was not enough time to determine the field would be harmed by their use; permit
was reinstated; Public Works stated they didn't have the budget to maintain the field up
to the standards that the Leagues wanted and they needed time to rejuvenate the field
during the winter. Discussion ensued regarding adult soccer usage of the field and the
extended youth soccer season.

In response to Mrs. Abbott, Greenwood Beach Road, Vice-Mayor Thompson stated fees
are charged for use of the field.
The Superintendent of Public Works stated McKegney Green is a sand base and not
designed for soccer, football or rugby; there's no way his Department can maintain the
field as it is now all year round. The Town Manager stated the Town spent $30,000 a
few years ago to repair the field. .

To amend the Rules and Regulations as proposed by the Joint Recreation
Committee with the addition of Item 12 that when a Use Permit is issued
for group activity that participants park in Blackie's Pasture and not on
residential streets.

Councilmember Ginalski requested the Jt. Recreation Department give copies of their
permits to the Police Department.
7. RIDGE TRAIL SIGNAGE PROGRAM (Status Report and Survey Authorization)
The Town Manager reviewed the Staff report; Council previously gave conceptual
approval to install 20 signs at a cost of $15 each; requested Staff to obtain an estimate
to place stairs in the Place Moulin area, and set a public hearing. Staff requests
approval for a survey of the stairs' area at a cost of $800 out of current budget;
installation of signs to be provided by volunteers; public hearing set for July 6.

8. CONTINUED TO .TUNE 8. 1994 - MARINERO ESTATES PRECISE
DEVELOPMENT PLAN (AP. #58-100-20, and 21; Applicants: Treffinger Walz
& MacLeod, John Collette, Receiver for Internal Revenue Service, Owners: Harry
Stonehi11 & Robert Brooks - Review Proposal to Construct at Least 21 Homes at
the End of Lyford Drive)

9. RESIDENTIAL PARKING CONTROLS (Introduce Consideration of Establishing
Parking Permit Program in Certain Neighborhoods - 10. BLACKlE'S PASTURE
PARKING (Reconsider Pay Parking Program
Vice-Mayor Thompson stated both these issues have been raised at the Homeowner
Association Summit meetings; asked if paid parking at Blackie's Pasture would be legal
due to how funds were received; consider maintenance costs included in parking fees;
in conjunction with paid parking at Blackie's, he suggested consideration of
neighborhood sticker program. Requested Staff to look at resident sticker programs of
other communities.

Bruce Abbott, Greenwood Beach Road, stated Blackie's Pasture has become an
attractive nuisance; Council has responsibility to look after community; asked Council
to consider those who live close to Blackie's Pasture and make some accommodation for
them; supported paid parking as long as it doesn't drive cars into surrounding neighbors;
supported resident parking permits.
Councilmember Ginalski raised questions of where a parking program would be
implemented; how to accommodate guests; enforcement; fees.
Doris Dante, 25 Pine Terrace, urged Council to act quickly; issue additional sticker for
guests; fees would pay for enforcement; asked what Council's timeframe would be for
implementation of a program. Vice-Mayor Thompson stated it will not get done within
the next two months. The Town Manager noted that administration of such a program
has a significant cost and enforcement factor; would get input from other communities.
Ms. Dante stated there is a widespread issue that needs to be addressed.
Wayne Snow, 100 Jefferson Drive, has been opposed to fee parking in Blackie's Pasture
in the past; willing to look at issue again; Greenwood Beach Road, Pine Terrace,
Hawthorne Terrace are impacted now; volunteered assistance to formulate a program.

Joy Easom, 1828 Lagoon View Drive, noted Mar West area draws a lot of people on
weekends; favored permit parking in neighborhoods and paid parking in Blackie's
Pasture.

Councilmember Wolf suggested consider weekday parking at Blackie's Pasture which
appears to be residents; consider that fee parking will exacerbate overflow parking in
neighborhoods; high level of enforcement would be needed; entire program needs to be
evaluated; not in favor of paid parking at Blackie's.
The Town Engineer suggested fees on weekends only.
Vice-Mayor Thompson directed Staff to contact other cities and return recommendations
to the Town Council on July 6; program would need to be self-sustaining.
ACCEPTING GRANT OF EASEMENT
The Town Attorney stated three members needed to approve placing an item on the
agenda and determining need to take immediate action. This date, it came to the Town
Attorney's attention that a resident who was selling her property had everything ready
to record at the Recorder's Office, the loan had been funded, the people moved into
the house, however, there was an Easement the person was granting to the Town, which
they couldn't record because the Town had never accepted it. All the improvements
have been installed for over ten years, however, the Easement never got accepted. The
need to take immediate action is to assist this resident in solving the problem.

The Town Attorney reviewed the history of the improvements which included a new
storm drain pipeline to take water off their property across other properties and tie into
the CAL/TRANS drainage on Tiburon Blvd. which was completed in 1983; Grant Deed
granting easement to the Town was drafted but never formally accepted; request Council
to formally accept this easement. The Town Manager stated he and the Town Engineer
can attest to the improvements that were involved.

The Town Manager stated the Marin County Managers will consider this letter at their
next meeting.
12. Ltr. from Doris Symonds to Town Council dated May 23, 1994 (Removal of
Eucalyptus Trees - Angel Island)
Informational.
AL KUHN'S LETTER
Vice-Mayor Thompson stated former Councilmember Kuhn has requested permission
to continue working on projects begun during his tenure on the Council. Council didn't
think his efforts needed to be formalized.

K. ADJOURNMENT
There being no further business before the Town Council of the Town of Tiburon, Vice-
Mayor Thompson adjourned the meeting at 9:45 P.M. to 7:30 P.M., Wednesday, June
8, 1994, to consider Marinero Estates project.
