MINUTES
CALL TO ORDER
Mayor Wolf called the regular meeting of the Town Council of the Town ofTiburon to order at
7:32 P.M., Wednesday, May 1, 1996, in Council Chambers, 1101 Tiburon Boulevard, Tiburon,
California.

E. COUNCIL. COMMISSION & COMMITTEE REPORTS
1) Marin County Commission on Aging. Jim Rice, Tiburon representative, gave a brief report and
handed out the Commission's newsletter and annual report. Council expressed their appreciation
to Mr. Rice for his work on the Commission. Mayor Wolf moved to reappoint Jim for another
term and Council unanimously voted in favor of her motion.
2) BelvederelTiburon Library Agency--Reappointment of Trustees. Richard Rozen said that
according to the Agency By-Laws, trustees' terms were staggered. He said Sharon Bass' one-
year term was completing in July but she had decided to exercise her option [per the Agency by-
laws] to serve another term. He said the trustees felt it would be a good idea to keep continuity
since the library project was still underway (construction having just begun). He also said the
Agency was conducting final interviews for an Executive Director at their May 4 meeting.
Councilmember Thayer said Ms. Bass should be given highest priority but asked if other
candidates should be interviewed. Mr. Rozen said it was Ms. Bass' right to serve another term.
Council agreed to formalize Ms. Bass' appointment at a later meeting. It was also noted that
Alan Littman's term will expire in April, 1997. Town Staff to calendar.

3) Safety Issue - Path near McKegney Green!riburon Boulevard. Councilmember Thompson said
that children had been seen walking on Tiburon Boulevard near the bus stop [at Stewart Drive].
He said that CalTrans should be alerted to improve their safety barrier and that the Soccer League
should be asked to help control the situation. Thompson also proposed that the Town add a set
of stairs to incorporate the already-used paths [short-cuts].
During public hearing, Bill Tiege, representing Pine Terrace Homeowners' Association, said the
Soccer League's permit required parking at Blackie's Pasture, not in nearby neighborhood streets.
He asked the Town to remind the League of this agreement.
Hank Broderick, Del Mar, said the paved path [leading from the Green] did not resemble the
actual foot traffic. He said what was needed was a direct route from the bike path to the existing
path constructed in a safe way.
Eric Schmidt said he was unhappy with The Ark photo of"Blackie's statue in a litter box."
Mayor Wolf said the item would be heard later.
Town Manager Kleinert said Town Staff had already looked into the [path] situation and would
come back with recommendations.
F. CONSENT CALENDAR
4) Town Council Minutes #1083 (April 3, 1996); #1084 (April 10, 1996); #1085 (April 17,
1996).
5) Guns for Gifts Exchange Program (Resolution).
6) MMWD Replacement of County Fire Flow Infrastructure (Authorize $500 Funding Share for
County-wide Survey).

G. NEW BUSINESS
7) New Town Hall Facilities - Project Management Team/Appointment of Hal Edelstein as Co-
Chair of Building Advisory Committee. Town Manager Kleinert gave the Staff report proposing
creation of a Project Management Team comprised of Jim Wilson, Hal Edelstein and Town
Engineer Moharnmadi. He said Wilson and Edelstein would continue to provide services free of
charge to the Town, except for reimubursable out-of-pocket expenses, and that the Town
Engineer's services were already covered in his contract.
Kleinert further discussed the approval process for change orders on the project. He said all
change orders would be forwarded first to the Project Management Team, then to the Town

Manager for final action. All change orders affecting the contract price by more than $5,000 or
the completion date by more than 10 days, would be subject to approval by Town Council, unless
the Town Manager determined that "immediate approval is necessary because of potential danger
to persons or property or to ensure timely completion of the project."
Council asked to be provided with a running tally of change orders on a montWy basis.
Council also agreed to formally designate Hal Edelstein as Co-Chair of the Building Advisory
Committee.
Town Staff agreed to return to Council with an appropriate resolution.
H. PUBLIC HEARING
8. Revision of Chapter 23 of the Municipal Code - Adoption of new Town Traffic Ordinance.
Mayor Wolf opened and closed the public hearing. There was no public comment.

Mayor Wolf read, "An Ordinance of the Town Council of the Town of Tiburon Repealing the
Existing Chapter 23 of the Tiburon Municipal Code and Adding a new Chapter 23 to the Tiburon
Municipal Code Regulating Motor Vehicles and Traffic."

9. Revitalization of Downtown as Resident-Serving Community. Mayor Wolf opened a
discussion about creation of a task force to study the downtown business situation and reverse the
trend of business closures in downtown. She said the suggestion to create a task force had been
made at a recent Hillhaven Homeowner's Association meeting, At that time she proposed waiting
a short while to give Safeway time to explore leasing their space to another market, but due to
subsequent events such as the Standard 5 & 10 closure and near-closure of Wells Fargo Bank, she
said it was time to move forward.
Mayor Wolf said she hoped the new library and Town Hall would be a catalyst for downtown
revitalization. She proposed that the task force have at most seven members and be a mix of
residents and merchants.

Town Manager Kleinert said the Chamber of Commerce had expressed support at their Board
meeting.
Mayor Wolf opened the public hearing.
Dian Ashley, President of the Tiburon Peninsula Chamber of Commerce, said she thought it was a
wonderful idea and ''we've got to work together to make our community viable."
Laurie Richmond, owner of Parsley's Hat Shop in Tiburon for eight years, said if Town
businesses were not supported they would be forced to leave. She said she had been encouraging
people to shop, as well as live in Town, and volunteered to serve on the task force. She said she
had served on a planning commission, town council, school board, and was familiar with the
problems and issues of small towns.
Ms. Richmond also said that the business community make a lot of contributions to charity and
never received thanks or recognition from people in the community for their efforts.
Eric Schmidt said he and his wife moved here because it was a beautiful community but he felt
that "commercialization destroys community." He said the merchants deserved a fair chance but
he would not like to see the encroachment of commercial interests into residential areas.
Councilmember Thayer said it was the Town's policy to promote resident-using services, but
"the economic forces around us" required the need to "roll up our sleeves and stem the tide."
Councilmember Thompson congratulated Mayor Wolf on the title of her speech. He said that
people often confuse the concept [of revitalization of business] with physical growth, and this was
not what the Town wanted. Thompson suggested having a core gr~up of people with specific
skills to serve on the task force, and said he would like to be on it or serve as Council liaison,
especially since he was also serving on the Marin Economic Commission.
Council directed Staff to advertise the formation of the task force in the local press and accept
applications from interested parties.
J. STAFF & TOWN MANAGER REPORTS
10. Blackie's Statue - Safety Improvements. Town Manager Kleinert said Staff had asked the
Town's insurance carrier (ABAG)for advice on how to handle the liability potential of children
climbing on and possibly falling off of Blackie's statue. ABAG advised Town staff to put sand
around the statue which led to a public outcry that it looked like a sandbox.
Larry Smith, Blackie's Brigade, suggested digging down about six inches to recess the sand.
During public hearing, Hal Edelstein lamented the "overreaction to the terror ofliability," and said
that parents needed to take responsibility for their children's actions. He said the recessed sand

was an improvement but suggested using another, darker material so that the look of the pasture
would be preserved.
Eric Schmidt concurred with Mr. Edelstein, and said that the "frivolous lawsuit is a scourge to
society." He suggested the Town tell its insurer to look for something really dangerous.
Mayor Wolf closed the public hearing.
Town Manager Kleinert said the wooden "sandbox" border had already been removed and the
sand would be recessed by Staff.
11) Temporary Relocation of Public Safety Antennae - SugarloafWater Tank. Town Manager
Kleinert submitted Chief of Police Herley's report regarding MMWD's request for temporary
relocation of the public safety antennae while work was being done on the Sugarloafwater tank.
Although Town Manager Kleinert said that no problems were anticipated, Councilmember Thayer
questioned references in Herley's memo to a "worst case scenario" ofMMWD not allowing the
public agencies future use of the tank site, and the possible erection of a cellular phone company
tower at the site.
Town Manager Kleinert said Staff would gather further information.
12) Designated Parking Space at Town Hall. Town Manager Kleinert said Town Staff had been
assigned reserved parking spaces and that the police would begin issuing citations to violators on
June 1, 1996. He also said there were designated parking spaces for visitors at Town Hall.
Town Manager Kleinert discussed possible retreat dates. Council tentatively agreed to the
afternoon ofJune 7 for a Town Councilffown Staff retreat, and Saturday, June 8 for Town
CouncilJPlanning Commission. Kleinert reconfirmed an adjourned Council meeting on May 29 to
review final bids and award the Town Hall contract.

There being no further business before the Town Council of the Town ofTiburon, Mayor Wolf
adjourned the meeting at 8:52 p.m" sine die.
