TOWN COUNCIL
MINUTES
CALL TO ORDER
Mayor Wolf called the regular meeting of the Town Council of the Town of Tiburon to order at
7:30 P.M., Wednesday, April 17, 1996, in Council Chambers, 1101 Tiburon Boulevard, Tiburon,
California.

D. RECOGNmON OF TOWN SERVICE
Town Manager Kleinert asked that the names off our Town employees who had completed 10
years of service be read into the record: Romney Fennell, Building Department Secretary; Sgt.
Laura Judd; Sgt. Pete Tomaszewski; Corp. Jim McVeigh. Sgt. Tomaszewski was present and
received a round of applause.
Kleinert also showed Council a plaque from The United Way commending Town employee Joan
Miranda for her work as "extraordinary coordinator" of the Town Staff 1995 United Way
Campaign.
Council extended their congratulations to all of the above.
E. COUNCIL. COMMISSION & COMMITTEE REPORTS
Building Advisory Committee. Chair Jim Wilson said the committee was at a critical point in that
the Town was about to entire into the bidding process for the new Town Hall project. He
reported that there had been no significant changes to the plan drawings presented to Council and
Planning Commission at their joint March 20, 1996 meeting.
Mayor Wolf asked how the Library Agency had come to choose the second lowest bidder on their

project. Wilson explained that the lowest bidder had failed to list the mechanical contractor on
their proposal and the Agency had voted 4-2 to award the contract to Mid-State Construction, the
second lowest bidder.
Wilson listed the following dates: April 19 pre-bid and on-site meeting; May 15 bids due. He also
proposed bringing the final bids to a special Council meeting on May 29 for approval and award
of the bid. Wilson said he and fellow committee member Hal Edelstein would volunteer their
time for project management during construction. Councilmember Hennessy asked whether the
Town Engineer would be included. Wilson said Town Engineer Moharnmadi had come to most
of the Building Advisory Committee meetings and had seen the site elevations, etc.
Chair Wilson said funds were already set aside and available for the project. He estimated a 300-
day construction period, beginning in June, 1996 and completing in February, 1997.
Council thanked Wilson, Edelstein and Town Attorney Danforth for their work.
F. CONSENT CALENDAR
2. Joint Planning Commission!rown Council Minutes - #1082, March 20, 1996. Councilmember
Hennessy added a verbatim quote to the statement about her ability to vote on the Town Hall
project on page 15.
Council also added Item 7, "Letter from Marin Environmental Forum Re: Earth Day Waste Free
Lunch Day, April22, 1996," to the Consent Calendar.

G. NEW BUSINESS
3. Ratification of Approved Design Review Modifications - Carport at 2024 Paradise Drive.
Planning Director Anderson gave a brief report on the background of the remodeling of residence
which resulted in a Settlement Agreement with the previous owners. That agreement called for
further approval by Council of any changes to the carport/garage after approval by the Design
Review Board. The modifications approved by DRB included replacement of a 3-1/2 foot
wrought iron guardrail with glass windbreak with a sliding glass door (South Elevation);
replacement of another wrought iron guardrail with a green metal guardrail with clear glass fascia
at top (East Elevation); and replacement of a four-foot wrought iron gate with a 3-1/2 foot metal
gate with green metal and clear glass fascia at top (West Elevation).
Councilmember Thayer said he had received a request from [paradise Drive neighbor] Tib Lizza
to continue the hearing, and also referred to a letter from the applicant's architects saying they
could not be present at the hearing.

David Broadsley, design architect with the Field office [see: letter mentioned above] was present
and answered Council's specific questions about the proj ect.
There was no public comment during public hearing.
Councilmember Thayer said he had received a call from a member of the Homeowner's
Association asking that Staff ensure that half of the bars were removed from the gate, per the
DRB approval. He also mentioned Mr. Lizza's concern regarding a trellis on the side of the
building.
Stan Cook, owner of the property, said the trellis was flat against the house and was smaller than
the previous one, and agreed to talk to the neighbors about it. Planning Director Anderson said
the issue of the trellis was moot because it was not in the Settlement Agreement.

I. COMMUNICATIONS
8. Letter to Town Council from Lyford's Cove/Old Tiburon Homeowners' Association re:
Traffic Safety (April 1, 1996). Ian Pearson, 2177 Centro East, informed Council of the efforts
made by the Association to create awareness and improve driving safety in their neighborhood.
He said specific problems were due to an increase in traffic in that area, and that he had worked
with Police ChiefHerley and the Traffic Safety Committee on solutions, including additional
signage and median dots. Pearson said the group sought Council support and suggested that
their neighborhood plan might be used as a model for other areas of Town.
Councilmember Thayer said it was clear there had been "a lot of careful analysis and widespread
participation" in the effort, and that "it gives me great joy to see a neighborhood trying to solve
problems" in this manner.
Mayor Wolf thanked Mr. Pearson for his efforts,
G. NEW BUSINESS
4. MMWD Report - Replacement of County Fire Flow Infrastructure. Mayor Wolf said she had
received a call from Betsy Cutler who wanted an opportunity to make a presentation about the
topic. Wolf said she was not prepared to endorse the request for funding as presented in the
recommendations of the Fire Flow Study Group,
Town Manager Kleinert said the cover letter from Board of Supervisors Chairman Hal Brown
only asked for endorsement in concept, and that the group planned to do more community

surveying before putting the matter before the voters in November.
Mayor Wolf said the proposed distribution of costs seemed to benefit some communities more
than others. Councilmember Thayer he was unable to match the numbers to the narrative portion
of the report. Both Thayer and Wolf referred to Fairfax Councilmember Egger's remarks [at
MCCMC] about the need to share the costs more equitably.
Town Manager Kleinert said Tiburon would receive some seismic improvements.
Councilmember Thayer volunteered to represent the Town Council on a one-time MCCMC
subcommittee to hear Ms. Cutler's presentation.
Mayor Wolf asked for the item to be tabled and said that although Council supported the need for
improvements to the water system, more work needed to be done on the study and cost-sharing.
H. PUBLIC HEARING
5. Revision of Chapter 23 of Town Municipal Code - Traffic Ordinance (1st reading). Chief of
Police Herley said there were no substantive changes to the ordinance, but the revisions would
"clean up and make [it] easier to use."
Town Attorney Danforth said she had tightened the provisions for abandoned vehicles, and the
ordinance would now require moving a vehicle at least one car length.
Town Engineer Moharnmadi said he had also reviewed the proposed changes.

6. ReviselRepeal Portions of Chapter 5 and 14B; new Chapter 14B - Public Facilities
Development Fees (1st Reading). Planning Director Anderson said some old fees for housing and
recreation were no longer applicable, and that the Town planned to raise traffic mitigation fees
next month.

Councilmember Ginalski referred to a letter from Bob Holmes, Director ofGovemmental
Relations for the Marin Association of Realtors, which warned against shifting costs to any
builder/developer. Councilmember Thayer said he had received calls, as well.
Anderson said that the new ordinance was almost word for word the same as the old one.
Town Attorney Danforth said the case cited in Mr. Holmes letter (Ehrlich v. Culver City) was not
applicable.

J. STAFF & TOWN MANAGER REPORTS
9. Status of Martha Company Property Applications. Planning Director Anderson said the
applications for pre-zoning and the precise development plan of the project, now called "Easton
Point," were on file and deemed complete. He said Town staffhad received the Draft
Environmental Impact Report in January, which was scheduled for public release on May L
Anderson recommended extending the 45-day review period to 60 days, and noted that Planning
Commission would hold public hearings on the project in June or July.
Councilmember Hennessy said it might be helpful for Council and the Planning Commissions to
have a workshop with Terry Watt [person who prepared EIR] in order to gain understanding and
background on the project. Planning Director Anderson said a workshop could be arranged
during the review period.
On another matter, Councifmember Ginalski asked if the Council's retreat with the Planning
Commission had been scheduled, and when the presentation by Senior Housing Advisory
Committee regarding the Ned's Way project would take place.
Town Manager Kleinert agreed to return to Council on May 15 with a proposed schedule for and
further discussion of the above.

Chief of Police Herley informed Council of the Earthquake Preparedness Fair at Reed School on
April 27 from 12:00 - 4:00 p.m,
Town Manager Kleinert said the Coastal Clean-Up was scheduled for May 4.
Councilmember Hennessy said she was attending a County-wide" Future of Technology"
Conference on May 22,
K. ADJOURNMENT
There being no further business before the Town Council of the Town ofTiburon, Mayor Wolf
adjourned the meeting at 8:30 p.m., sine die.
