"....., RESOLUTION NO. 46-2001 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON APPROVING THE PINE TERRACE VICINITY ACCESS IMPROVEMENT PROJECT AND ADOPTING A MITIGATED NEGATIVE DECLARATION AND MITIGATION MONITORING PROGRAM THEREFOR ASSESSOR PARCEL NOS. 55-131-02 & 55-131-19 WHEREAS, the Town Council of the Town of Tiburon does resolve as follows: Section 1. Findings. A The Town ofTiburon is proposing to construct pedestrian access improvements in the vicinity of the Pine Terrace Subdivision. The proposed project would involve construction of a new 130-foot long, ADA-compliant pedestrian pathway which would provide direct access to the Tiburon Multi-Use Path from the school and residential uses to the north of Tiburon Boulevard; upgrading of an existing substandard pathway in the vicinity; and elimination of existing unauthorized casual pedestrian routes that are believed to be unsafe. The new path would be constructed over a Town-owned easement (still being secured) on a parcel currently owned by the Pine Terrace Homeowners' Association. The connection would provide much-needed access to the MUP for residents in the neighborhoods north of Tiburon Boulevard and for schoolchildren going to and from Del Mar Middle School, which is located directly across Tiburon Boulevard. This connection would provide the only means of direct access to the MUP for a Ih-mile stretch that parallels Tiburon Boulevard. B. The Tiburon Planning Department prepared an initial study for this project, along with a draft Mitigation Monitoring Program, which determined that there were no potentially significant environmental effects related to the project which could not be mitigated through modification of the project and through mitigation measures adopted as conditions of approval for the project. C. The Tiburon Planning Department determined that based upon the Initial Study, a Mitigated Negative Declaration was required for the project pursuant to the requirements of the California Environmental Quality Act (CEQA). On June 20, 2001, a Draft Mitigated Negative Declaration was completed. Notices of such were posted, and advertised in the Ark newspaper to announce a 21-day public review period from June 20, 2001 to July 11,2001 for review and comment on the Initial Study/Draft Negative Declaration, in conformance with CEQA requirements. A notice of Page I 0(2 . " il "......, the public hearing on the Draft Mitigated Negative Declaration and the project applications was also posted, and published in the Ark newspaper. '---.- E. The Town Council held a duly noticed public hearing on July 18, 2001 and heard and considered testimony from interested persons. The Town Council found that the project is consistent with the Tiburon General Plan, as Policy PR-8 of the Parks & Recreation Element of the General Plan states that "the Town should require publicly-accessible off- road connecting trails between recreation areas (developed, developable, and open space) and neighborhood areas." The proposed connection would provide a new handicapped- accessible connection between the neighborhoods near Pine Terrace and the Multi-Use Path, as well as eliminating an existing unsafe pedestrian connection in the same area, and upgrading an existing substandard path in the vicinity. Section 2. Aooroval. NOW, THEREFORE, BE IT RESOLVED that the Town Council approves the Pine Terrace Vicinity Access Improvement Project; and BE IT FURTHER RESOLVED that the Town Council hereby approves the Mitigated Negative Declaration and adopts the Mitigation Monitoring Program for the project as complete and adequate for the purposes of approving the project, subject to the implementation of mitigation measures as outlined in attached Exhibit "A", Mitigation Monitoring Program. ,""'" BE IT FURTHER RESOLVED that the Planning Director is directed to file the Notice of Determination with the Marin County Clerk within five (5) working days of the project approval.
