Dear Tiburon City Council members and Chief Cronin,
I served as Associate Pastor of Westminster Presbyterian Church(240 Tiburon Blvd)for twenty-one years. When
the street license plate cameras were installed in front of our building in 2010,I was very concerned that civil
liberties would be abused. However,I read that the data would be saved for a very short time(24 hours?)and used
only to search for those who had committed crimes in Tiburon. I understood that the data would be kept
confidential and protected. I also knew the family of Joan Rosenthal and realized that this was a compromise to
calm residents and possibly to help solve any crime such as her tragic murder if it were to happen in the future.
However,over the past few months I have read that you have changed vendors to be now using Vigilant Solutions to
store license plate data collected from these cameras. I have also learned that nationally Vigilant Solutions now
shares their collected data with U.S.Immigration and Customs Enforcement(ICE). That goes far beyond the
promises made to the community of confidentiality.
Your action risks the possibility of law-abiding Marin families being torn apart-families of people who use
Tiburon parks and dine in Tiburon restaurants,families of people who work in our local business and in our homes,
families of people who are our cherished friends and visit in our homes. Do you think that thinking people of
Tiburon are aware of this choice you have made?
I read in the Marin Independent Journal of February 15,2018,that the town of Belvedere has handled this issue
differently. I am unclear how Belvedere can use Vigilant Solutions and still Chief Seyler can say that"The
information is ours. It belongs to Belvedere and is 100 percent under our control." If that is true,WHY
WOULDN'T TIBURON DO THE SAME?
I beg you to either DROP VIGILANT SOLUTIONS(preferred)or use the system implemented by Belvedere and do
it immediately.

Dear Mayor Fraser:
Thank you for your December 18, 2017 and February 5, 2018 letters regarding the ferry
service from Tiburon to Angel Island State Park. In your letters, you expressed an
interest in understanding the State of California, Department of Park and Recreation's
("Department") Request for Proposal ("RFP") process and expressed your support for
the current ferry service provider. I would also like to thank you for your interest and
participation in the public input meeting related to the RFP that occurred December
2017.
In awarding a concession contract, the Department is required to follow Public
Resources Code §5080.02 — 5080.29. These sections outline the process the
Department must follow when advertising, bidding, operating and maintaining
concession agreements throughout the State. Pursuant to law, the Department is
required to advertise for bid any proposed concession contract with a proposed duration
term of more than 2 years.'
When issuing an RFP fora proposed concession contract longer than two years in
length, the Department follows the parameters outlined in the Public Resources Code
(§5080.05 - §5080.26), CA Code of Regulations Title 14 §4400, and Department
guidelines. Below please find a summary of the Department's RFP process:
1. Gather initial information to inform RFP development, including a Public Input
Meeting
2. Notify the State Park and Recreation Commission ("SPRC") of intent to advertise
RFP or seek SPRC determination of concession compatibility with the Park Unit
General Plan, whichever is applicable
3. Notify the Joint Legislative Budget Committee of intent to advertise RFP, as
applicable
4. Obtain Department approval on the RFP and Sample Concession Contract
5. Advertise the RFP
6. Conduct a Pre-Proposal Meeting
7. Open Question & Answer Period and provide responses and errata, as
applicable
8. Close bidding and conduct public opening of proposals
9. Convene Concessions Award Board to evaluate proposals
Public Resources Code § 5080.16 provides conditions when the Department may negotiate or renegotiate a
concession contract. However, none of the conditions apply to the Tiberon —Angel Islands State Park Ferry
Service.

10.Provide notice of intent to award

12.Prepare final contract for concessionaire and Department signatures
13.Obtain control agency approvals
14.Execute contract
As you know, the McDonogh family began operating this ferry service in 1991 under the
authority for two-year concession contracts afforded under the Public Resources Code.
That concession contract has been operating on a month-to-month basis since 1993.
Month-to-month arrangements do not provide the assurances necessary for businesses
to make long-term investments in their concession operations, which ultimately provides
better experiences for the public we collectively serve. As such, the Department is
making a concerted effort to address the number of month-to month contracts active
throughout the State. The Department recently established a Partnerships Office, which
includes dedicated concession contract staff. The Partnerships Office reviewed all the
concession contracts throughout the State Park System in an effort to establish long-
term agreements for concession services. Subsequently, all of the concession
opportunities at Angel Island were identified as priorities for the RFP process to achieve
our objectives to expand and improve visitor services at Angel Island State Park.
The Department appreciates the concerns both you and the community have about the
McDonogh's maintaining their contract with the Department, and we understand the
meaningful relationship they have with the community, which was evident by the
community's support during the December 2017 public input meeting. However, as
described earlier in this letter, the Department is required by law to competitively bid a
concession when seeking a long-term service contract with any vendor.
You also requested evaluation criteria for the upcoming RFP. The Department cannot
provide scoring criteria of the RFP prior to issuing the public notice to solicit proposals.
This ensures impartiality and a fair process. However, after the RFP has been released,
there will be a pre-proposal meeting. While this meeting is designed for potential
bidders, they are also open to the public. Pre-proposal meetings offer an opportunity for
dialogue between potential bidders and concession program staff to address questions
regarding the RFP requirements as well as the general bid submission process. This
forum also allows for potential adjustments to the RFP prior to the proposal submission
deadline.
I appreciate your invitation to attend an upcoming Town Council meeting and your
request that this meeting take place prior to releasing the RFP for the ferry service. The
Department's RFP process includes a robust public engagement component and we
appreciate your interest in facilitating additional public meetings for this particular RFP.
However, as you are aware, the Department held a pre-RFP release, public input
meeting on December 14, 2017 which you and at least 50 members of the community
attended. We heard from members of the public about their ideas on what would be of
most benefit to the community and public. This meeting was very helpful in crafting the

RFP and while we understand and appreciate your desire for an additional pre-release
meeting, it is important that the Department follow a consistent statewide process for all
concession contracts.
As noted earlier in this letter, part of the Department's public engagement for RFPs
include additional public meetings after release of the RFP. The Department will send
you and the town council notice of these public meetings so that you have an
opportunity to attend and participate. We would appreciate any suggestions you have
regarding ways to ensure maximum public participation in these meetings.
Again, thank you for your letter. We appreciate your feedback and comments regarding
this RFP and the ferry service concession contract. Please feel free to reach out if you
have additional questions or comments.

Cleaning Rags—Repurpose old T-shirts and towels to use as cleaning rags instead of

squeegee to wipe windows for best results.
