HomeMy WebLinkAboutTC Res 1999-08-18 (5) J-..., RESOLUTION NO. 3353 A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF TIBURON REVISING RESOLUTION NOS. 2764 and 2953 CONCERNING THE PLANNING AND BUILDING FEE SCHEDULE AND ADOPTING AN ENGINEERING FEE SCHEDULE FOR THE TOWN OF TIBURON WHEREAS, the Tiburon Municipal Code requires that any changes to the Planning & Building Department's filing and processing fees be set forth by Resolution of the Town Council, and WHEREAS, it is the intent of the Town Council that such fees be used to reimburse the Town for the costs of providing the services for which the fees are assessed, thereby maintaining productive and efficient service levels commensurate with the work demands within the Planning & Building Department, and WHEREAS, from time to time it is necessary to revise these fees to reflect actual costs incurred by the Planning & Building Department in the normal course of its operation and according to its obligations to administer State statutory requirements under the authority of Town ordinances, and __ WHEREAS, the Town of Tiburon has provided required notice and held a public hearing pursuant to state law and local ordinances. NOW, THEREFORE, BE IT RESOLVED that the Town Council of the Town of Tiburon does hereby adopt revised Building, Planning, and Engineering Fee Schedules, attached hereto as Exhibits A, B, and C respectively, said fee schedules to become effective 60 days from the passage of this resolution. Plan Checking Fees: All construction plans must be checked for conformance with State and Town regulations, A plan checking fee shall be paid to the Town along with submittal of construction drawings and specifications for review. Plan checking fees shall be 65% of the building permit fees, Where plans are incomplete, or changed so as to require an additional plan check review, an additional plan review fee shall be charged by the Town at $60.00 per hour with a minimum charge of one hour. 6. This fee is set at $250.00 by Ordinance No, 354 N.S, Permit - Penaltv Fee: In addition to the investigative fee, a person who starts any work ~or which a permit is required without first having obtained a permit shall, if later issued a permit, pay a penalty not to exceed four (4) times the permit fee, However, this provision does not apply to emergency work if the Building Official or Chief Building Inspector determines that such work was urgently necessary and that it was not practical to obtain a permit before starting work. Fees shall be submitted in full at the time of application submittal to the Town. B. Pursuant to a written request, the Town Council may grant a full or partial waiver of fees pursuant to policies adopted by Resolution of the Town Council, C, Portions of fees may be refunded upon withdrawal of an application; the amount of the refund shall be determined by the Director based upon the amount of work done by the Town prior to withdrawal. - D, Full fee credits may be granted by the Director toward resubmittal of applications if applications are withdrawn and resubmitted within 60 days from the date of withdrawal. E. In the event that any work has been undertaken or use made of property without legal authority prior to completion of the requisite procedures necessary to authorize such work or use, the applicant shall pay two times the required fee amount. F. Where work requires more than one permit, the full fee shall be collected for each and every permit required, G, Pursuant to Loning Ordinance Subchapter 6, some fee waivers are applicable to projects providing below market rate housing units, - Tiburon Fee Schedule 13 Adopted 8118199 I"'" EXHIBIT C TO\VN ENGINEER'S REVIEW FEES SCHEDULE The Town Engineer's application review fee includes the time spent by the Town Engineer and his staff to make one (1) site inspection, an initial review of submitted plans and maps for completeness, a second review of the submitteu plans and maps, a consultation with Planning or Building Department staff and preparation of written conditions and/or reco=endations. The Town Engineer's fee for additional work beyond that specified above, and for other applications where a specific fee is not listed, will be based on the actual time spent by the Town Engineer or his staffin accordance with the Town Engineer's personnel schedule. Where not otherwise indicated, a fee will be determined by the Town Engineer ifreview is determined to be necessary by the Planning Director or Building Official. The required fee shall be paid directly to Town Engineer prior to Town Engineer beginning his review. The applicant shall execute Town Engineer's Work Order and Agreement for professional services prior to Town Engineer performing any work. - Town Engineer's fees are as follows: A.
