Election Code Section 10229 or hold June 5, 2018, city council election
Recommended Motion/Item Description
Consider two resolutions and discuss whether to appoint City Council candidates pursuant to
California Elections Code § 10229, or to hold the.lune 5, 2018, City Council election.

This June, the terms of Mayor Marty Winter and Councilmember Tames Campbell will expire.
The candidate filing period for the election closed on March 9, 2018. Two candidates, James
Campbell and Marty Winter, have submitted nomination papers to the City Clerk for the two
vacant seats.
Discussion
Given that there are not more candidates than offices to be elected, Elections Code § 10229
allows the City Council to adopt one of the following courses of action:
1. Appoint to the office the persons who have been nominated; or
2. Appoint to the office an eligible elector if no one has been nominated (this option does
not apply to the decision currently before the City Council); or
3. Hold the election if either no one or only one person has been nominated.
By selecting option (1) above, the persons appointed would qualify, take office, and serve
exactly as if elected at a municipal election for the office. Selection of this option would also
cancel the June 5, 2018, election and the City Clerk would not accept for filing any statement of
write-in candidacy that is submitted after the appointments are made.
Selection of option (3) above, would result in the election taking place as scheduled on June 5,
2018. Option (2) is not relevant to the Council's decision in this instance because two candidates
have been nominated to the two open seats. Should the Council choose to take no action, the
election would be held as scheduled.

Two resolutions have been prepared for the City Council's consideration regarding this matter.
The first draft resolution serves to appoint the two individuals nominated and thereby cancel the
June 5, 2018 election. The second draft resolution provides for the election to held as scheduled.
Fiscal Impact
To date, $333.83 has been spent on election related items including required notices and
nomination materials. Should the election be held in June, the additional cost to the City would
be between $2,499—$4,284. The range is based on election cost estimates provided by the Marin
County Registrar of Voters of approximately $1.75 — $3.00 per registered voter in Belvedere. If
there are no other jurisdictions besides the County of Marin on the June 5, 2018, ballot with
whom to share the cost of the election, the final cost could be toward the higher end of that
range.
Recommendation
Consider two resolutions and discuss whether to appoint City Council candidates pursuant to
California Elections Code § 10229, or to hold the June 5, 2018, City Council election.

WHEREAS, on January 8, 2018, the City Council of the City of Bclvedere adopted Resolution
No. 2018-01 calling for a consolidated general municipal election to be held on June 5, 2018, to
fill two expiring terms on the City Council; and
WHEREAS, as of the close of the nomination period on March 9, 2018, there are not more
candidates than offices to be elected; and
WHEREAS, Section 10229 of the Elections Code of the State of California allows one of the
following courses of action to be taken by the City Council:
1. Appoint to the office the person who has been nominated.
2. Appoint to the office any eligible voter if no one has been nominated.
3. Hold the election if either no one or only one person has been nominated; and
WHEREAS, a notice was published on March 13, 2018, in a newspaper of general circulation
pursuant to law; and

Celebrate Earth Day on April 22
Earth Day is an annual, worldwide event that celebrates efforts to protect our
environment. This Earth Day, choose one of the following eco-conscious activities to
reduce waste and pollution here in Marin County.
* Plant a tree. Trees produce oxygen, absorb carbon dioxide and counter toxic
byproducts of burning fossil fuels - all of which help improve air quality. Plant a
tree in your own backyard with your family or friends or join local volunteer
groups such as Marin County's Dedication Tree Day at Lagoon Park, where you
can plant a tree to commemorate a loved one and help restore habitats for local
wildlife. You can also support organizations that aim to reverse deforestation, like
the Canopy Project.
* Switch to reusable. Instead of purchasing coffee in a paper cup with a plastic top,
bring your own coffee cup.
* Shop Local. Shop for groceries at local farmer's markets. Not only is the food
fresh, but it's virtually free of packaging! Make smart decisions about what to
purchase and be sure to eat what you buy to avoid wasting food.
* Make a backyard compost pile. Composting reduces your carbon footprint and
repurposes food waste. You can purchase a backyard compost bin from your local
